Terms & Conditions
Effective date: August 21, 2026
These Terms & Conditions govern your use of www.harkencoaching.com, operated by Harken Coaching & Advisory LLC, doing business as Harken ("Harken," "we," "us," or "our"). By accessing or using the website, you agree to these terms. If you do not agree, please do not use the website.
Website Purpose
This website provides general information about Harken's executive and career coaching services. Website content is offered for informational and educational purposes. Visiting the website, submitting an inquiry, or scheduling an initial conversation does not create a coaching relationship or obligate either party to enter into an engagement.
Coaching Services and Separate Agreements
Coaching services are provided only after Harken and the client enter into a separate written coaching agreement. That agreement may address the scope and duration of services, fees, scheduling, cancellations, confidentiality, intellectual property, termination, and other engagement-specific terms.
If these Terms & Conditions conflict with an executed coaching agreement, the coaching agreement controls with respect to the services covered by that agreement.
Coaching Scope and Professional Disclaimer
Harken provides coaching that supports reflection, awareness, decision making, leadership development, career development, and client-directed action. Coaching is a collaborative process. Clients retain responsibility for their choices, actions, and results.
Coaching is distinct from psychotherapy, counseling, psychiatric care, medical care, or other mental-health treatment. Harken does not diagnose, treat, prevent, or cure any physical, mental, or emotional condition. Coaching does not replace care from a licensed healthcare or mental-health professional.
Information on this website and information shared through coaching does not constitute legal, tax, accounting, investment, financial, medical, or mental-health advice. You should consult an appropriately qualified professional concerning those matters and your particular circumstances.
Harken cannot provide emergency or crisis support. If you are experiencing a medical or mental-health emergency, contact local emergency services. In the United States, call 911 or call or text 988 for the Suicide & Crisis Lifeline.
Client Responsibility and No Guarantees
Coaching outcomes vary according to the individual, the circumstances, and factors outside Harken's control. Harken does not guarantee employment, promotion, compensation, earnings, leadership performance, business performance, career advancement, or any other particular result.
You are responsible for evaluating information, exercising your own judgment, conducting appropriate due diligence, obtaining specialized professional advice when needed, and deciding whether and how to act.
Testimonials on this website describe the experiences of particular individuals. They do not promise, guarantee, or necessarily represent the experience or results of another client. Any material relationship connected to a testimonial will be disclosed where required.
Online Coaching and Technology
Coaching sessions may be delivered online through third-party video, scheduling, messaging, payment, or client-management platforms. Online coaching offers convenience and flexibility, while also presenting limitations and technology risks. It does not provide the immediate physical support available from an in-person healthcare or emergency-service provider.
No internet connection, device, or digital platform can be guaranteed to be completely secure or continuously available. Third-party platforms may experience outages, delays, interruptions, or security incidents. If a coaching session is materially interrupted by a technology failure, Harken and the client will make reasonable arrangements to resume or reschedule the affected portion.
Your use of a third-party platform is also subject to that provider's terms and privacy practices. Please review those terms if privacy, confidentiality, accessibility, or security is a concern.
Scheduling and Electronic Communications
The website may link to third-party scheduling services. Appointment availability, confirmation, cancellation, and rescheduling requirements may be communicated through the scheduling service or a separate coaching agreement.
By contacting Harken electronically, you consent to receiving responses and other communications electronically. Ordinary email and online communications are not guaranteed to be fully secure. Please avoid sending highly sensitive information through an unsecured communication channel.
Website Content and Accuracy
Harken makes reasonable efforts to present accurate and useful information. Website content may contain errors, become outdated, or omit information relevant to your circumstances. Harken may modify, remove, or update website content at any time without notice.
You should not rely on website content as the sole basis for a consequential professional, career, financial, legal, medical, or personal decision.
Intellectual Property
Unless otherwise stated, the website and its content, including text, branding, logos, graphics, photographs, frameworks, methods, downloads, and other materials, are owned by or licensed to Harken and are protected by applicable intellectual-property laws.
You may view and use the website for your personal, noncommercial purposes. You may not copy, reproduce, modify, publish, distribute, sell, license, create derivative works from, or commercially exploit website content without prior written permission from Harken.
Materials supplied during a coaching engagement may be subject to additional intellectual-property terms in the applicable coaching agreement.

Privacy
Your use of the website is also subject to Harken's Privacy Policy, which explains how information may be collected, used, disclosed, and protected.
